Ten Returned Penalty Mailings

The City's activity log records ten returned administrative-penalty or monitoring-fee mailings between 02/01/2024 and 11/05/2025 M004 M007 M008 M009 M010. The densest cluster is 06/19/2025: four "LETTER RETURNED" entries, all logged by the same enforcement officer, all certified penalty mail, and all dispositioned "RETURN TO SENDER UNCLAIMED UNABLE TO FORWARD" M008. Two used the correct trust name "JACKIE BARITELL TRUST"; two used the inverted-letter form "JACQUELINE M. BARTITELL TRUST C/O JACQUELINE BARITELL."

The returns fall on six separate dates. The inverted-letter trust name appears three times - on two certified mailings and one first-class mailing M004 M008. The cited pages also show correct BARITELL or JACKIE BARITELL addressing before and after those entries M004 M005 M007 M008. The returned mailings carried the administrative penalties and monitoring fees that continued to accrue while the penalty-instrument cycle Card 15 and the rate doubling Card 14 continued.

IN PLAIN TERMS

Between February 2024 and November 2025, ten of the City's penalty and fee mailings came back undelivered while the fines kept accruing. Three of the returned entries spelled the trust name "BARTITELL" instead of "BARITELL," even though the file shows the City also knew and used the correct name. Not every notice failed: the log records green cards received on other cycles. And city code may treat service as complete when mailed. This card does not say the returned envelopes voided service; it records the delivery history behind the penalty cycle.

RECORD CHAIN

  1. The City had repeated correct-name mail history to this owner and trust. The cited activity-log pages show repeated correct BARITELL or JACKIE BARITELL addressing before and after the BARTITELL entries, including entries on M004, M005, M007, and M008. The misspelled entries appear between correct-name entries, not at first contact.
  2. The activity log records each return in a dated "LETTER RETURNED" entry. The ten entries fall on 02/01/2024 M004, 03/07/2025 M007, 06/19/2025 (four entries) M008, 08/07/2025 (two entries) and 09/26/2025 M009, and 11/05/2025 M010; each is an administrative-penalty or monitoring-fee mailing dispositioned "RETURN TO SENDER."
  3. Three of the ten entries address a misspelled trust name. Those entries read "JACQUELINE M. BARTITELL TRUST" - the inverted-letter form - in the text of the produced activity log M004 M008, not as an extraction artifact.
  4. Penalties continued to accrue across the same period. The undelivered mailings carried the administrative penalties and monitoring fees that the City continued to assess in successive cycles over the same months M004 M007 M008 M009 M010.

The record also shows formal notice was received on other cycles: "GREEN CARD RECEIVED" delivery confirmations for penalty/monitoring-fee mail on 02/15/2024, 03/20/2024 (×2), and 07/09/2024 M004 M005, and at least one later signed certified green card for the 07/16/2025 hearing packet, logged as received 06/11/2025 with a signature reading "Gwen" and dated 06/05/2025 M033. Notice on this case was intermittent, not absent.

FULL CIRCLE

The City may argue: service was legally complete on mailing. Under SCC.1.04.100, "service by certified or regular mail shall be deemed effective on the date of mailing," and subsection (C) provides that "the failure of any person entitled to receive a notice and order shall not affect the validity of any proceedings taken under this code." The mail went to the address of record, the inverted-letter form is harmless because the street address and "C/O JACQUELINE BARITELL" line identified the recipient, and a returned envelope therefore changes nothing about the City's compliance.

This card does not assert that the penalties are void for defective service. It addresses actual notice. The record shows ten returned penalty mailings, three addressed to the inverted-letter trust name, on a file whose log shows correct-name addressing before and after those entries M004 M005 M007 M008 M009 M010. Under a rule that deems service effective on mailing, the penalties may have continued while these particular notices came back undelivered.

The returned-mail entries and the misspelled trust name appear in the City's own Case File, produced against the closed-production baseline carried by Card 4. The penalty cycles those mailings carried continued through the same period Card 14 Card 15. The produced record does not show a resolution of the returned cycles.

The finding is limited to what the log records: ten penalty mailings returned undelivered, three addressed under an inverted trust name, during months in which the penalty cycle continued.
