CPRA REQUEST — the basis of the April 12, 2023 Notice and Order, Case 23-009185 Public Records Act request — City of Sacramento, Community Development Department, Code Enforcement / Housing and Dangerous Buildings. Code Enforcement Case 23-009185, 4880 T Street, Sacramento, CA 95819. This request is limited to the records behind the Notice and Order dated April 12, 2023 (case-file pp. 123–132) and the appeal of it. Please produce records in their native format, not as print reports. 1. The "attached Notice." The March 21, 2023 Buster Preliminary letter (p. 117) refers to an attached Notice ("please see attached Notice"). The produced file places the Correction List (p. 118) after the letter and no Notice. Please produce the Notice that was attached to and mailed with the March 21, 2023 letter as sent, and the mailing record for that letter. 2. The City's written standard for the description. Sacramento City Code § 8.100.720(A)(2) requires a Notice and Order to contain "a brief and concise description of the conditions found to render the building substandard"; § 8.96.130(B)(2) is the dangerous-building parallel. Please produce any written policy, procedure, template, form instruction, checklist, or training material in effect on April 12, 2023 that states how that description is to be prepared, what it must contain, and whether a Correction List reading "This is not a complete Violation List" satisfies it. 3. Any amendment before the appeal window closed. Any amended or supplemental Notice and Order, corrected Correction List, or other written statement of conditions served on the owner between April 12, 2023 and the close of the thirty-day appeal period, and any record of a decision not to amend. 4. The appeal and its refusal. The document index lists "Appeal Refusal - Monitoring Fee - No Appeal Fee" dated 09/07/2023 (p. 14), and the activity log records a 09/27/2023 call from the owner's representative about "a denial for the Mon fee appeal that he submitted with no appeal fee included" (p. 25). Please produce: the appeal form(s) received from the owner or her representative in August 2023, with the City Clerk and Hearing Section date stamps; the refusal letter of 09/07/2023 and its proof of service; any record of the City's consideration of a fee waiver under § 8.100.760(D) or § 8.96.170; and any record identifying which appeal track (Notice and Order, Administrative Penalty, or Cost Recovery) the refused appeal was treated as. 5. Where the merits were ever heard. The City's appeal packet states that "The violations will not be discussed during the appeal or hearing process unless you are being charged for a summary (emergency) abatement" (p. 142), and that the Notice and Order appeal is the only forum in which "the violations cited by the officer/inspector were valid at the date the N&O was issued" is decided. Please produce any record of any hearing, review, or determination in this case at which the validity of the B31/B59 violations on April 12, 2023 was considered, and the decision. If any item is withheld or does not exist, please say so for that item specifically (Gov. Code § 7922.540(a)), and identify the systems and custodians searched (Gov. Code § 7922.600).
