CPRA REQUEST — Records retention schedule and destruction records, City of Sacramento Code Enforcement
Requester: Christopher T. Foley.
This request is limited to ONE subject: what the City is required to keep, and what it has destroyed.
I request:
1. The City's current records retention schedule, and every version in effect from January 1, 2023 to the present, covering Code Enforcement and Community Development Department records — specifically the series covering case files, inspection reports, inspection photographs, field notes, text messages, and staff email.
2. All certificates of destruction, destruction logs, disposition authorizations, or equivalent records, from January 1, 2023 to the present, reflecting the destruction of any record in the series identified above, including the series item, the date range destroyed, the date of destruction, and the official who authorized it under Gov. Code section 34090.
3. All records reflecting whether any record relating to Case 23-009185 or 4880 T Street has been destroyed, deleted, purged, or allowed to auto-delete, and the authority for doing so.
4. All records reflecting the City's retention rules and auto-deletion settings for staff email and text messages, including any Microsoft 365 or equivalent retention or deletion policy applied to Code Enforcement staff accounts, and the effective dates of each.
5. All litigation-hold, preservation-notice, or retention-suspension records issued in connection with Case 23-009185 or 4880 T Street, or a statement that none was issued.
Context for the search, not a request for legal conclusions: the City has certified that it holds no records responsive to requests for inspection photographs taken at this property on September 16, 2025 (Request 26-2206, closed June 4, 2026) and no records responsive to a request for communications between Paul Lovato and Karin Owens concerning the August 20-21, 2025 access dispute (Request 26-2491, closed July 28, 2026). These items are intended to establish whether those records were destroyed under an authorized schedule, and if so when and by whom.
If the City locates no responsive record for any item, please state that expressly and produce the records of the search, including who made the no-records determination under Gov. Code section 7922.540(b).
Preservation: this request is written notice to preserve all records identified above and to suspend any retention or auto-deletion rule that would otherwise operate on records relating to Case 23-009185 or 4880 T Street, effective on receipt and continuing until the City advises in writing that it is lifted.
