California Public Records Act Request - City of Sacramento
Requester: Christopher T. Foley, authorized representative for the owner of 4880 T Street, Sacramento, CA 95819 (APN 011-0135-010-0000). Code Enforcement Case 23-009185.
Under the California Public Records Act, Gov. Code section 7920.000 et seq., I request the records described below.
This request concerns the City's August 21, 2025 re-entry onto 4880 T Street after the initial doorstep cancellation/refusal. The City's case note states that Lovato and PBI Cosley arrived at 11:30 a.m.; the caretaker wanted to cancel the inspection; the City said it would move forward with an inspection warrant; about thirty minutes later Lovato received a call from "the property owners rep (Karin)" stating the City could enter; Lovato contacted PBI Cosley; and the officials returned and performed the backyard inspection.
I request:
1. Any owner-signed authorization, designation, agency form, consent form, letter, email, text, note, or other record dated on or before August 21, 2025 authorizing Karin Owens to consent to entry, grant inspection access, act as the owner's representative, or communicate with the City for inspection-access purposes concerning 4880 T Street or Case 23-009185.
2. Any City record dated on or before August 21, 2025 showing that City staff verified, evaluated, discussed, accepted, questioned, or relied on Karin Owens's authority to consent to entry or inspection access at 4880 T Street.
3. Any written consent-to-enter form, inspection-consent form, access authorization, occupant consent record, owner consent record, or similar record for 4880 T Street, at any date in Case 23-009185.
4. Any administrative inspection warrant, warrant application, affidavit, declaration, court filing, draft warrant, legal review, warrant checklist, or warrant-related communication for 4880 T Street or Case 23-009185, including records considered or prepared before, during, or after August 21, 2025.
5. Any communications, notes, emails, text messages, call logs, task records, Teams messages, or other records from August 20-22, 2025 among Paul Lovato, Bo Cosley, Karin Owens, Jackie Baritell, Records Management, Code Enforcement supervisors, City Attorney personnel, police, fire, animal control, or any other City staff concerning inspection access, cancellation, consent, entry, an inspection warrant, police/fire/animal-control assistance, or the August 21, 2025 re-entry at 4880 T Street.
6. Any City policy, staff directive, training material, checklist, or procedure in effect on August 21, 2025 governing third-party consent to residential code-enforcement inspection, owner-representative authority, caretaker authority, consent-to-enter documentation, and when staff must seek an administrative inspection warrant instead of relying on consent.
7. Any records reflecting the search conducted for the records above, including custodian inquiries and system searches if no responsive records are located.
This request does not ask the City to answer legal questions. It asks for records showing the authority, consent, warrant, and staff-search record supporting the August 21, 2025 entry described in the City's own case note.
