We will notify you on or before March 17, 2026 as to whether the City is in possession of non-exempt records responsive to your request.” The problem is that this language keeps moving the City’s “determination” date. Gov. Code § 7922.535(a) requires the City to make that determination within 10 days, and § 7922.535(b) allows an extension for unusual circumstances but also says: “No notice shall specify a date that would result in an extension for more than 14 days.” The CPRA does not authorize repeated/rolling two-week notices that keep postponing the determination. For the record, the City has sent the same “we will notify you on or before…” notice multiple times for this request: Jan 20, 2026 (09:09 PST): notify by Feb 3 Feb 3, 2026 (08:58 PST): notify by Feb 17 Feb 17, 2026 (08:53 PST): notify by Mar 3 Mar 3, 2026 (08:51 PST): notify by Mar 17 These notices are delaying the § 7922.535(a) determination itself (whether the City possesses non-exempt responsive records), not just providing a production estimate after a determination. I’m trying to resolve this cleanly and quickly without unnecessary escalation. If yes, provide the determination date and the estimated date/time when the export (or first production set) will be made available. If the City has not made the determination yet, please cite the specific basis for extending it further under § 7922.535(b), and provide the determination.
